Welcome to Gestly. By accessing or using our website at gestly.com and related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Service Description

Gestly is a platform that allows users to create, personalize, and share video greeting cards. Our services include:

  • Recording or uploading video messages.
  • Selecting themed card designs for various occasions.
  • Generating shareable links and printable QR code cards.
  • Scheduling card deliveries for future dates.
  • Managing contacts and sending bulk greeting cards.

2. Account Registration

  • You must be at least 13 years old to use Gestly.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and complete information during registration.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at support@gestly.com if you suspect unauthorized access.

3. Prohibited Content

You agree not to upload, create, or share content that:

  • Is illegal, harmful, threatening, abusive, harassing, or defamatory.
  • Contains sexually explicit material or promotes violence.
  • Infringes on intellectual property rights of others.
  • Contains malware, viruses, or harmful code.
  • Impersonates another person or entity.
  • Is spam or unsolicited promotional content.
  • Violates any applicable law or regulation.

We reserve the right to remove content and suspend or terminate accounts that violate these policies, at our sole discretion, without prior notice.

4. Payments & Pricing

One-Time Purchases

Moment plan purchases are processed immediately. Once payment is confirmed, your video card is activated and the shareable link is generated.

Subscriptions

Memory and Legacy subscriptions are billed monthly or annually. Subscriptions automatically renew unless cancelled before the renewal date. You can cancel your subscription at any time from your dashboard.

Refund Policy

Due to the digital nature of our products, purchases are generally non-refundable once the video card has been created and the shareable link generated. However, if you experience technical issues that prevent you from using the service, you may request a review within 7 days of purchase by contacting support@gestly.com. We will review each case individually.

Price Changes

We reserve the right to modify pricing at any time. Active subscribers will be notified at least 30 days before any price increase takes effect on their next billing cycle.

5. Intellectual Property

Our Content

All card designs, templates, themes, UI elements, logos, and other creative assets on Gestly are owned by us or our licensors and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

Your Content

You retain ownership of the videos you upload and the messages you create. By using our Service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service. This license terminates when you delete your content or account.

6. Account Suspension & Termination

We may suspend or terminate your account if you:

  • Violate these Terms of Service.
  • Upload prohibited content.
  • Engage in fraudulent or abusive behavior.
  • Attempt to circumvent security measures or rate limits.
  • Use the Service for any unlawful purpose.

Upon termination, your right to access the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

7. Limitation of Liability

To the maximum extent permitted by law, Gestly and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not responsible for any loss or damage resulting from your reliance on the Service.

9. Indemnification

You agree to indemnify and hold harmless Gestly and its affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a prominent notice on our website. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
